What to Do in a Criminal Law Emergency in Germany
Police Summons for Suspect Interrogation
If you receive a police summons or a letter from the public prosecutor’s office, one principle is essential: you are not required to make any statement.
You should consistently exercise this right before obtaining legal advice. Remaining silent cannot be used against you and is often the most important protective step at the beginning of a criminal investigation.
After you contact me, I take over communication with the investigative authorities, request access to the case file (Akteneinsicht), and assess whether providing a statement is advisable in your case. Early legal representation is crucial in criminal investigations, as strategic decisions at this stage often determine the course and outcome of the proceedings.
If you are summoned as a witness in Germany, caution may be necessary. I provide confidential advice on your rights and obligations and, if requested, accompany you as witness counsel to police interviews, prosecution questioning, or court hearings. Early legal guidance helps prevent misunderstandings and ensures that your interests are protected throughout the proceedings.
Dawn raid
When the police, public prosecutor’s office, or customs authorities appear at your door without prior notice, the search itself cannot be prevented.
Stay calm and contact a criminal defense attorney immediately. I am available by phone at any time and, in many cases, can speak with the investigators while the proceedings are still ongoing. The police are not obligated to wait for a criminal defense attorney, but remaining calm increases your chances.
What you should do yourself:
Do not provide any information about the matter and do not get involved in conversations. Relatives or employees are also not required to make statements on site.
Ask for a copy of the search warrant and note down the name and telephone number of the officer in charge.
Object to all measures and do not sign any documents — while at the same time refraining from any resistance.
You do not have to unlock or hand over passwords or devices. If documents or data carriers are to be taken away, ask to be allowed to copy or back them up beforehand.
Arrest
An arrest or the order of pre-trial detention is one of the most serious interventions in a criminal case. For those affected — as well as for relatives — it often creates an acute emergency situation. In such moments, it is crucial to obtain legal assistance immediately.
Those affected should not provide any information about the matter, even in the hope of being released earlier by making a spontaneous confession. Statements made under pressure can hardly be corrected later. Resistance must be avoided at all costs.
If you are affected yourself or a family member has been arrested, you can reach me by phone or cell phone. I will immediately contact the authorities and take care of the next steps, such as arranging visits from relatives during pretrial detention.
